Terms & Conditions

Welcome to Tap Jams™. These Terms & Conditions (“Terms”) govern your use of the Tap Jams website, products, services, digital experiences, collaborations, and related features. By accessing our website, purchasing or using our products, submitting materials for a collaboration, or participating in our programs, you agree to these Terms.

1. General Use

Tap Jams creates physical and digital experiences designed to connect people with music, creators, playlists, and other content.

Certain Tap Jams products may use NFC technology, QR codes, URLs, or other access methods to connect users to Tap Jams pages, third-party streaming services, websites, social platforms, or other digital destinations.

Tap Jams does not guarantee the continued availability of any third-party platform, link, song, playlist, album, artist page, website, or other externally hosted content.

We reserve the right to modify, suspend, replace, update, or discontinue any product, service, feature, digital destination, or portion of the Tap Jams platform when reasonably necessary.

You must be at least 13 years old to independently use our digital services. Purchases by minors should be made with the involvement and permission of a parent or legal guardian.

2. Creator, Artist & Partner Collaborations

Artists, creators, labels, managers, curators, brands, venues, businesses, and other partners participating in a Tap Jams collaboration must provide accurate information and must have the necessary rights and permissions for any materials they submit.

By submitting artwork, photographs, logos, names, trademarks, descriptions, promotional materials, links, or other content or materials (“Submitted Materials”) to Tap Jams, you represent that you own the Submitted Materials or have obtained all rights, licenses, consents, and permissions necessary to provide them to Tap Jams and authorize their use as described in these Terms.

You grant Tap Jams a limited, non-exclusive license to use, reproduce, adapt, resize, crop, format, display, incorporate, market, promote, and otherwise use the Submitted Materials as reasonably necessary to design, manufacture, display, market, promote, sell, distribute, and support the applicable Tap Jams collaboration and related products.

Unless you notify Tap Jams otherwise in writing, this permission also extends to future Tap Jams products, formats, editions, merchandise, packaging, accessories, and promotional materials developed in connection with the applicable collaboration or project.

A collaborator may withdraw permission for new or future uses of Submitted Materials by providing written notice to Tap Jams at Support@TapJams.com. Any withdrawal will apply prospectively and will not require Tap Jams to recall, destroy, modify, or discontinue products or materials that were already manufactured, produced, sold, published, ordered, or committed to production before the withdrawal was received.

Unless otherwise agreed in writing, ownership of Submitted Materials and other intellectual property remains with its respective owner. Nothing in these Terms transfers ownership of a collaborator’s music, recordings, compositions, artwork, photographs, trademarks, Submitted Materials, or other intellectual property to Tap Jams.

Collaborators are responsible for ensuring that their participation and the Submitted Materials do not violate any agreement or obligation they have with a record label, publisher, distributor, management company, licensing organization, photographer, designer, other rights holder, or third party.

Tap Jams reserves the right to request evidence of authorization or permission when reasonably necessary and may decline, suspend, or discontinue a collaboration if sufficient rights or permissions cannot be verified.

Certain projects, products, or collaborations may require setup, design, production, or other fees. Applicable fees and terms will be disclosed before a project is accepted or produced.

Submission of a project or collaboration request does not guarantee acceptance by Tap Jams.

3. Music & Intellectual Property

Tap Jams does not claim ownership of music, recordings, compositions, album artwork, photographs, trademarks, or other intellectual property belonging to artists, labels, publishers, streaming platforms, collaborators, or other rights holders.

Rights to music and other third-party content remain with their respective rights holders.

Tap Jams products may provide links or access points to music and content hosted by third-party services. Tap Jams does not host or distribute the underlying music files unless expressly stated otherwise.

The inclusion of a song, artist, album, playlist, streaming service, brand, or other third-party content does not by itself imply ownership, sponsorship, affiliation, or endorsement by Tap Jams.

Nothing in these Terms grants a customer or other user any ownership or license to reproduce, distribute, publicly perform, commercially exploit, or otherwise use music, artwork, trademarks, or other third-party intellectual property accessed through a Tap Jams product except as separately permitted by the applicable rights holder.

4. NFC, QR Codes, Links & Digital Content

Some Tap Jams products may contain or display NFC technology, QR codes, URLs, or other methods for accessing digital content.

A compatible device, camera, NFC capability, internet or cellular connection, and/or an account or subscription with a third-party service may be required to access certain content.

Tap Jams cannot guarantee compatibility with every device, operating system, browser, streaming service, application, or future technology.

Digital destinations associated with a Tap Jams product may be updated, changed, replaced, redirected, or removed when reasonably necessary, including when content becomes unavailable, a collaborator requests an authorized change, a third-party service changes its functionality, or continued access is no longer reasonably practicable.

Unless expressly stated otherwise, purchasing a physical Tap Jams product does not constitute the purchase or ownership of the music, streaming content, digital media, or other third-party content accessible through that product.

5. Third-Party Platforms & Services

Tap Jams may link to third-party streaming services, websites, social networks, stores, applications, or other platforms.

Use of those services is subject to the individual terms, privacy policies, subscription requirements, geographic restrictions, account requirements, and availability of those third parties.

Tap Jams does not control and is not responsible for interruptions, removals, changes, account requirements, subscription fees, pricing, advertising, availability, or other actions taken by third-party platforms.

A third-party platform may change or discontinue its services at any time, which may affect links or functionality associated with a Tap Jams product.

6. Affiliate & Third-Party Revenue

Tap Jams may participate in affiliate programs, referral programs, advertising programs, platform-based revenue programs, or other arrangements that may generate revenue when users visit, purchase through, or otherwise interact with certain links or services.

Where required by applicable law, Tap Jams will provide appropriate disclosures regarding affiliate or sponsored relationships.

Participation in an affiliate or referral program does not increase or alter the price charged by the third party unless clearly disclosed.

Tap Jams is not responsible for changes to third-party affiliate programs, eligibility requirements, revenue policies, tracking systems, commissions, or payouts.

7. Purchases & Product Availability

Product prices, designs, availability, quantities, features, materials, and specifications are subject to change.

Some Tap Jams products may be limited edition, individually numbered, made to order, collectible, customized, promotional, or available only for a limited period.

We reserve the right to limit quantities, reject or cancel orders, correct pricing or listing errors, or discontinue products when reasonably necessary. If Tap Jams cancels a paid order before fulfillment, any amount paid for the canceled item will be refunded as required by applicable law.

Colors, dimensions, artwork placement, finishes, materials, printing, and other characteristics of physical products may vary slightly from photographs, mockups, digital previews, or between individual units due to manufacturing, printing, display settings, materials, or the handmade or customized nature of certain products.

Customers are responsible for reviewing personalization, customization, sizing, artwork, or other customer-provided information before submitting an order where applicable.

Any separate shipping, return, refund, preorder, customization, or promotional policies displayed on the Tap Jams website are incorporated into these Terms where applicable.

8. Collectibles, Limited Releases & Promotional Items

Tap Jams may offer limited-edition products, Collector’s Editions, numbered collectibles, promotional items, rewards, tokens, special releases, accessories, or other limited offerings.

Availability is not guaranteed unless expressly stated. Tap Jams may establish additional eligibility, redemption, expiration, transfer, quantity, availability, or other terms for specific promotions, collectibles, or releases.

Product numbering, edition size, packaging, included components, features, and other details may vary by release and will be described where applicable.

Where an item is redeemable for a future product, experience, benefit, or reward, the specific redemption terms provided with that item or promotion will apply.

Unless expressly stated otherwise, ownership of a collectible or limited-edition Tap Jams product does not grant the purchaser ownership of, or commercial rights to, any music, artwork, trademarks, photographs, or other intellectual property depicted on or accessible through the product.

Tap Jams reserves the right to substitute a promotional reward with one of reasonably comparable value if the originally intended reward becomes unavailable, to the extent permitted by law.

9. Content, Collaboration & Project Removal

Tap Jams reserves the right to decline, suspend, discontinue, or remove a project, collaboration, product, listing, link, or digital page when reasonably necessary.

Reasons may include suspected intellectual property violations, unlawful or prohibited content, inaccurate information, inactivity, discontinued products, insufficient demand, failure to meet applicable collaboration requirements, loss of necessary rights or permissions, third-party platform changes, or conduct that may harm Tap Jams, its customers, creators, partners, or community.

Tap Jams may also remove or modify links or digital destinations if the underlying content becomes unavailable, unauthorized, misleading, unsafe, unlawful, or materially different from the content originally associated with the product.

When reasonably possible, Tap Jams may attempt to contact an affected collaborator before permanently discontinuing an active collaboration.

10. Acceptable Use

You may not use Tap Jams products, services, websites, NFC features, QR codes, links, or digital pages for unlawful, fraudulent, abusive, misleading, infringing, or unauthorized purposes.

You may not attempt to interfere with, damage, disable, circumvent, reverse engineer, gain unauthorized access to, or misuse Tap Jams systems, technology, websites, NFC functionality, digital pages, or services.

You may not alter, replace, redirect, reproduce, or misuse a Tap Jams NFC destination, QR code, digital page, product identifier, or other Tap Jams feature in a manner intended to mislead others or falsely represent an association with Tap Jams.

You may not falsely represent yourself as being affiliated with Tap Jams or use Tap Jams trademarks, branding, product designs, graphics, packaging, or other intellectual property without permission.

11. Tap Jams Intellectual Property

The Tap Jams name, logos, trademarks, branding, website design, original product designs, original graphics, packaging designs, written content, digital page designs, and other materials created by Tap Jams are owned by Tap Jams or used under appropriate license and are protected by applicable intellectual property laws.

Third-party artwork, music, photographs, trademarks, and other materials appearing on Tap Jams products remain the property of their respective rights holders.

Nothing in these Terms grants permission to reproduce, manufacture, sell, distribute, modify, copy, or commercially use Tap Jams intellectual property without prior written permission.

The purchase of a Tap Jams product is for personal use unless otherwise expressly authorized and does not transfer ownership of Tap Jams intellectual property or third-party intellectual property incorporated into the product.

12. Disclaimer & Limitation of Liability

Tap Jams products and services are provided on an “as available” basis to the extent permitted by applicable law.

Tap Jams does not guarantee uninterrupted or permanent availability of digital pages, links, NFC functionality, QR destinations, third-party platforms, streaming content, or other digitally accessible features.

Tap Jams is not responsible for content hosted or controlled by third-party services or for the removal, modification, interruption, restriction, or unavailability of content or services controlled by third parties.

To the fullest extent permitted by applicable law, Tap Jams will not be liable for indirect, incidental, special, consequential, or similar damages resulting from the use of or inability to use our products, website, digital services, NFC features, QR codes, links, or third-party services.

Nothing in these Terms excludes or limits liability, rights, warranties, or remedies that cannot legally be excluded or limited under applicable law or consumer protection laws.

13. Indemnification by Collaborators

To the extent permitted by applicable law, collaborators agree to be responsible for claims, damages, losses, liabilities, and reasonable costs arising from Submitted Materials or instructions they provide to Tap Jams that infringe or violate the intellectual property, privacy, publicity, contractual, or other rights of a third party.

This provision does not apply to claims arising solely from modifications or uses made by Tap Jams that were not authorized by the collaborator or these Terms.

14. Termination

Tap Jams reserves the right to suspend or terminate access to its services, remove or redirect digital content, cancel collaborations, or discontinue products associated with violations of these Terms, suspected fraud, unlawful activity, intellectual property violations, loss of required permissions, or misuse of Tap Jams products or services.

Termination of a collaboration does not automatically require the recall or destruction of products already lawfully manufactured, sold, or committed to production before termination, unless otherwise required by law or agreed in writing.

Provisions that by their nature should reasonably survive termination, including provisions concerning intellectual property, liability, and obligations relating to previously produced products, will survive termination where applicable.

15. Changes to These Terms

Tap Jams may update these Terms from time to time to reflect changes to our products, services, policies, technology, business operations, or applicable laws.

Updated Terms will be posted on our website with a revised effective date.

Changes will apply prospectively to the extent required by applicable law. Continued use of Tap Jams services after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.

16. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles.

Nothing in this section deprives a consumer of protections or rights that cannot be waived under applicable law.

17. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

18. Entire Agreement

These Terms, together with any applicable policies, collaboration terms, product-specific terms, promotional terms, or other terms incorporated by reference, constitute the agreement between you and Tap Jams regarding the applicable products and services.

If separate written terms are entered into between Tap Jams and a collaborator for a particular project, those written terms will control to the extent they conflict with these Terms.
